RALEIGH, NORTH CAROLINA β A nonpartisan group of North Carolina attorneys has condemned President Donald Trump’s recent demands for personal loyalty from U.S. Supreme Court Justices, calling such expectations fundamentally incompatible with the rule of law just weeks before the nation’s 250th anniversary of independence.
North Carolina Lawyers for the Rule of Law, which comprises attorneys from across the political spectrum, issued a statement responding to Trump’s criticism of justices he appointed for rulings he disagreed with. The president asserted that Supreme Court justices should “be loyal to the person that appointed them,” according to the group’s statement.
Constitutional Separation of Powers at Stake
The lawyers’ organization emphasized that judges serve as an independent branch of government, not as presidential employees or political party servants. They noted the historical irony of such demands being made shortly before celebrating the Declaration of Independence, which specifically criticized King George for making “Judges dependent on his Will alone” and obstructing justice administration.
“From our state’s smallest federal courthouse on East Main Street in Elizabeth City, to our nation’s storied U.S. Supreme Court in Washington, D.C., a judge’s only loyalty is to the law and to the Constitution β not to the president who appointed them, not to the party that supported them, and not to any political outcome,” the group stated.
Justice Gorsuch Defends Judicial Independence
U.S. Supreme Court Justice Neil Gorsuch, one of the justices criticized by Trump, recently defended the principle of judicial independence. “Why do we have an independent judiciary? The framers did not want [judges beholden to political forces],” Gorsuch explained. “They said you have to have independent judges so that when you come to court, no matter how unpopular you are, you’re going to get fair, neutral application of the law.”
The North Carolina legal group acknowledged that judges are human beings who bring life experiences and viewpoints to the bench, noting that the legal system has always recognized this reality. However, they stressed that constitutional design intentionally separates judicial decision-making from political pressures.
